Terms of Sale

This is a translation provided for convenience. In the event of any discrepancy, the French version (“Conditions Générales de Vente”) prevails.

1. Purpose

These Terms of Sale govern the sale of digital services and graphic creations (the “Services”) offered on the websites flowgraines.fr and oretlienart.fr, both published by Aurélien Bessonnet, sole trader (auto-entrepreneur). They apply in particular to online courses, subscriptions, downloadable graphic packs and custom illustration orders (“commissions”). Placing an order implies unreserved acceptance of these Terms of Sale, which are available at any time on the Sites and prevail over any other version or conflicting document.

2. Services offered

The Sites offer various Services, including:

  • Online courses (“Flowgraines”) on flowgraines.fr: access to personal development programmes, either through a one-off payment giving access to the purchased content for as long as the service exists and remains reasonably available online (subject to the technical availability of the Sites), or through a monthly subscription.
  • Flowgraines monthly subscription: unlimited access to the courses available on the platform and, where applicable, to a community exchange or support space, for a fixed monthly price shown on the Site at the time of subscription (currently €9/month).
  • Graphic packs and visual resources on oretlienart.fr: sale of digital visuals (overlays, graphic elements, etc.) made available to the User as files downloadable after payment.
  • Commissions / custom illustrations via oretlienart.fr: creation of personalised illustrations based on the User’s request, a quote and terms agreed in writing (in particular by email).

3. Prices

Prices of the Services are expressed in euros (€) and are those displayed on the Sites at the time of the order. Prices may be changed at any time for the future, with no retroactive effect on orders already confirmed or subscriptions in progress.

Some Services, in particular online courses and graphic packs, may be offered on a “pay what you want” basis: a reference (suggested) price may be displayed for guidance and the User chooses the amount they wish to pay, subject to a minimum amount shown on the Sites (for example €0 or a specific minimum).

For commissions and custom services, the price is set case by case on the basis of a quote sent to the User and accepted by them before any work begins.

4. Ordering process

To buy a course or a graphic pack, or to take out a subscription on the Sites:

  • The User selects the desired Service (e.g. “Get the course”, “Monthly access”, graphic pack).
  • Where the Service is offered on a pay-what-you-want basis, they enter the amount they wish to pay.
  • They enter their payment details through a secure form handled by a third-party payment provider (in particular Stripe).
  • Once payment is confirmed, the Service is made available:
    • course or subscription: through the course list page on the Site;
    • graphic resources: through download links available in the user area (“My Profile”) or by any other means indicated.

For commissions / custom illustrations:

  • The User submits a request (form, message or email) with the information needed to understand the project.
  • A quote detailing the content of the service, the price, the payment terms and the estimated timeframe is sent to the User.
  • The order is considered accepted once the quote has been approved in writing (by email, click or signature) and, where applicable, a deposit specified in the quote has been paid.
  • The work is then created in accordance with the quote and delivered as digital files (by email, download link or any other agreed means).

The Sites may refuse or cancel an order for any legitimate reason (fraud, non-payment, breach of the Terms of Use or Terms of Sale, etc.).

5. Payment terms

For courses, subscriptions and graphic packs bought directly on the Sites, payment is made mainly by bank card via Stripe or any other online payment solution indicated at the time of the order. The Sites do not store the User’s card details.

  • One-off purchase (courses, graphic packs): full payment when ordering.
  • Monthly subscription: automatic monthly payment of the amount shown at the time of subscription (e.g. €9/month), renewed automatically unless cancelled by the User from “My Profile”, with effect at the end of the current period.

For commissions / custom illustrations, the payment terms (deposit, payment of the balance, bank transfer or other accepted means of payment) are set out in the quote approved by the User and form an integral part of these Terms of Sale.

6. Access restrictions

The Services are available to people over 18 years of age, or with the permission of a legal guardian, and require a verified account on the Site (see the Terms of Use).

7. Right of withdrawal and refunds

The Services offered on the Sites are, for the most part, digital content and services supplied without a physical medium and/or performed before the end of the legal withdrawal period.

7.1 Digital content available immediately (courses, subscriptions, graphic packs)

By ordering a course, subscription or graphic pack available immediately after payment, the User acknowledges and agrees that performance of the Service begins before the end of the withdrawal period and expressly waives their legal right of withdrawal for that Service.

For the sake of transparency, the Sites nevertheless apply the following contractual rules:

  • One-off course purchase: a 15-day satisfaction guarantee is offered. A full refund is possible within this period, provided the content has not been accessed (e.g. videos or materials not viewed or downloaded), by contacting contact@oretlienart.fr with your name, email, date of purchase and the course concerned.
  • Monthly subscription: no pro-rata refund is made for the current month. The User may however cancel at any time from “My Profile”; cancellation takes effect at the end of the period already paid for.
  • Graphic packs and downloadable resources: given the nature of digital files, no refund is possible once the pack has been made available or actually downloaded, except where it is technically impossible to supply the files (e.g. an unresolved broken link) or in the event of an obvious error attributable to the Sites. In that case, the User is invited to contact contact@oretlienart.fr.

7.2 Commissions and custom services

Commissions and custom illustrations are personalised services tailored to the User’s request. By approving the quote, the User acknowledges that work may begin before the end of the legal withdrawal period and accepts that, once work has begun, the legal right of withdrawal no longer applies.

Unless otherwise stated in the quote:

  • the User may cancel free of charge as long as work has not begun;
  • once a deposit has been paid and work has begun, the deposit is retained as compensation for the work already done, even if the User cancels;
  • if the Sites cancel (inability to perform the service), sums paid for the unperformed order are refunded.

8. Complaints

Any complaint should be sent to contact@oretlienart.fr. Flowgraines and Oretlienart undertake to respond within a reasonable time, usually within 30 days.

9. Personal data

In connection with the sale of the Services (courses, subscriptions, graphic packs and commissions), the Sites collect and process in particular the following data: email, first name, last name, payment data (through payment providers), purchase data (courses bought, packs downloaded, subscription status, order history) and, where applicable, IP address or browsing data.

Cookies and similar technologies may also be used for the proper functioning of the Sites and, subject to your consent, for audience measurement and statistics.

This data is processed in accordance with applicable data protection regulations. For more information about processing, retention periods or exercising your rights, please see the Privacy Policy.

10. Liability

The Sites undertake to provide Services that match their description at the time of the order. Courses, content and graphic creations are provided “as is” for personal or professional use within the licences granted, with no guarantee of any particular result (e.g. performance, audience, revenue).

If a technical problem makes a Service inaccessible or unusable (e.g. course unavailable, download link not working), the User is invited to contact contact@oretlienart.fr.

The Sites cannot be held liable for:

  • interruptions or malfunctions caused by third-party providers (e.g. Stripe, Firebase, host);
  • indirect damage (e.g. loss of data, loss of earnings, financial loss, damage to reputation);
  • the use the User makes of the content and visuals (compliance with the law, respect for third-party rights, etc.).

11. Governing law and disputes

These Terms of Sale are governed by French law. In the event of a dispute, an amicable solution will be sought first. Failing that, the courts with jurisdiction over Guyancourt shall have jurisdiction.
