Terms of Use

1. Purpose

These Terms of Use (the “Terms”) set out the conditions for using the websites flowgraines.fr and oretlienart.fr (the “Sites”) and the services offered on them, including online courses, subscriptions, graphic packs, illustration commissions and the game “La jardinerie”, available on the web and as an Android app (the “Services”).

Accessing and using the Sites implies full acceptance of these Terms. If you do not accept them, you must not use the Sites or the related Services.

2. Definitions

For the purposes of these Terms:

• “User”: any individual accessing the Sites, with or without an account, and using the Services.
• “Account”: the personal space created by the User, giving access to certain Services (courses, subscriptions, packs, etc.).
• “Services”: all the services offered on the Sites, including online courses, subscriptions, downloadable graphic packs, commissions / custom illustrations and the game “La jardinerie”.
• “Content”: all content made available on the Sites or through the Services, such as videos, texts, learning materials, visuals, illustrations and graphic packs.

3. Access to the Sites and user account

The Sites are available online, subject to the usual technical constraints of the internet. Some Services require an Account to be created first.

A single user Account is used for flowgraines.fr and oretlienart.fr, and for the game “La jardinerie”. From “My Profile”, the User can view their course access, subscription and resource/graphic pack purchases where available.

When creating the Account, the User agrees to provide accurate, up-to-date and complete information, and to keep it up to date. The User is responsible for keeping their login details confidential and for any use of their Account. If unauthorised use of the Account is suspected, the User must promptly inform contact@oretlienart.fr.

The Sites are intended for adult Users, or for minors who have the permission of their legal guardian. By using the Sites, the User declares that they have the necessary legal capacity.

4. Use of the Services

The User agrees to use the Sites and Services in accordance with these Terms, the Terms of Sale and applicable law.

In particular, the User agrees not to:

• use the Sites for illegal, misleading or malicious purposes;
• infringe the rights of third parties (copyright, privacy, image rights, trademarks, etc.);
• attempt to gain unauthorised access to information systems or to other Users’ accounts;
• circumvent the protection systems in place (for example unauthorised sharing of access, mass downloading, etc.).

Access to certain Services (courses, packs, commissions) may require payment, under the terms set out in the Terms of Sale.

5. Intellectual property and licences

Unless expressly stated otherwise, all Content available on the Sites and through the Services (courses, texts, videos, illustrations, graphic packs, design elements, logos, etc.) is the intellectual property of Aurélien Bessonnet or is used under licence. It is protected by copyright and, more generally, by intellectual property law.

5.1 Flowgraines courses and content

Flowgraines courses, programmes and materials are licensed to the User for strictly personal use (and, where relevant, professional use for their own needs), on a non-exclusive, non-assignable and non-transferable basis. The User may not:

• reproduce, distribute, share or communicate the Content to third parties (whether free of charge or paid);
• resell, rent, assign or make the Content available, in whole or in part;
• record or redistribute course videos or materials, beyond the uses explicitly allowed on the Sites.

5.2 Oretlienart graphic packs and resources

Buying a graphic pack does not transfer any intellectual property. The User obtains a non-exclusive, non-transferable licence to use the visuals:

• in their own content (streams, videos, thumbnails, social media, website, etc.);
• in a personal or professional context, including for commercial purposes (content monetisation, advertising).

However, the User may not:

• resell, redistribute, give away or include the visuals in packs, templates or products intended to be passed on;
• claim authorship of the visuals or remove author credits where present;
• substantially modify the visuals (e.g. heavy retouching, distorting the style) without specific written agreement. Purely technical adjustments (resizing, light cropping to fit a scene) remain possible.

5.3 Commissions and custom illustrations

For commissions / custom illustrations, unless otherwise stipulated in writing in the quote or contract, copyright remains the property of Aurélien Bessonnet. The User obtains a non-exclusive licence to use the illustration for the purposes defined in the quote (visual identity, social media, content, etc.), within the agreed scope.

Unless explicitly agreed otherwise, Aurélien Bessonnet reserves the right to show completed commissions in his portfolio, on the Sites or on his social media, as professional references. If the User wants a strictly confidential commission, this must be discussed and agreed in writing (for example through a specific mention in the quote).

6. The game “La jardinerie”

“La jardinerie” is a free introspection game, available at flowgraines.fr/jeu and as an Android app distributed through Google Play. Both versions use the same Account as the Sites, which is required to play.

The game is intended for people aged 13 and over. A User under 15 must obtain the agreement of a parent or the person with parental authority before creating an Account.

6.1 The nature of the game

La jardinerie is an educational game that invites you to explore your thoughts, emotions and dreams, and to take care of yourself. It is not a medical device, and it does not replace the advice or care of a healthcare professional.

6.2 Your content

The texts you write in the game belong to you. Aurélien Bessonnet acquires no rights over them, does not consult them and uses them for no purpose other than giving them back to you. You can erase them at any time from the game’s Settings. The data processed is described in the privacy policy of La jardinerie (in French).

When you send feedback from the game (bug, idea, suggestion), you allow Aurélien Bessonnet to draw freely on it to improve the game, without compensation.

6.3 Changes to the game

The game is provided free of charge and as is. It may change, be modified or be discontinued at any time. Aurélien Bessonnet strives to preserve the content of your garden during updates, without being able to guarantee it in all circumstances.

The game itself (texts, illustrations, sounds, characters including the guide Ério) is protected under the conditions set out in article 5.

7. Personal data

When the Sites are used (Account creation, purchases, course access, commissions), certain personal data is collected and processed (for example: email, first name, last name, order information, access history, etc.).

This processing complies with applicable regulations and is described in the Privacy Policy, supplemented for the game by the privacy policy of La jardinerie. There the User will find the purposes of processing, the legal bases, retention periods and how to exercise their rights (access, rectification, erasure, objection, etc.).

When browsing the Sites, cookies and similar technologies may be used to make them work properly (for example, to remember certain technical choices) and, subject to your consent, for audience measurement and statistics, notably through analytics tools provided by third parties.

By default, analytics cookies are not enabled without your explicit agreement. A banner lets the User accept or refuse them. This choice can be changed at any time from the Privacy Policy (“manage my cookies” link).

8. Limitation of liability

The Sites and Services are used at the User’s own risk. The Sites are provided “as is” and subject to availability.

Aurélien Bessonnet cannot be held liable for:

• temporary interruptions of access due to maintenance, updates or technical incidents;
• malfunctions attributable to third-party providers (host, payment provider, etc.);
• indirect damage (loss of revenue, audience or data, damage to reputation, etc.);
• the use the User makes of the Content and visuals (compliance with the law, respect for third-party rights, statements made in streams or publications using the visuals, etc.).

The Services offered (in particular personal development content) do not replace appropriate professional support (e.g. psychological, medical or financial). The User remains solely responsible for their choices and decisions.

9. External links and third-party services

The Sites may contain links to third-party websites or integrate services provided by external providers (for example: payment platform, host, analytics tools). These services are subject to their own terms of use, over which Aurélien Bessonnet has no control.

It is up to the User to read the terms and privacy policies of these third-party services before using them.

10. Changes to the Terms

These Terms may be changed at any time to reflect changes to the Sites, the Services or applicable law. In the event of a substantial change, a notice of the update may be displayed on the Sites.

The Terms that apply are those in force at the time the Sites are used. Users are invited to consult them regularly.

11. Governing law and contact

These Terms are governed by French law. In the event of a dispute, and failing an amicable settlement, the competent courts shall be those with jurisdiction over the place of business.
